The U.S. Department of Justice announced it is investigating Arizona State University after videos recorded by Accuracy in Media allegedly showed ASU employees discussing or responding to diversity, equity and inclusion (DEI) restrictions. DOJ said the videos indicate potential discrimination based on race, color, or national origin and attempts to hide practices from federal scrutiny. DOJ’s statement says the investigation will examine whether ASU subjected students to illegal discrimination through DEI-related policies covering admissions, recruitment, scholarships, tutoring, and other educational supports. ASU told Axios it believes it is in compliance with federal law and declined to comment on unauthorized recordings. The case reflects a new enforcement pathway that relies on independently obtained recordings to trigger federal scrutiny of campus practices.
