The U.S. Department of Justice opened an investigation into Arizona State University, alleging that the university’s diversity, equity and inclusion efforts may have violated civil rights law. The DOJ said it will examine ASU’s admissions, recruitment, scholarships, tutoring, and educational support policies to determine whether the public university “subjects its students to illegal discrimination” under Title VI. DOJ linked the investigation to viral videos that it says suggest unequal treatment and attempts to hide practices from federal scrutiny. ASU’s system previously removed references to diversity and affirmative action from board policies in June, but Arizona has not adopted a statewide DEI ban, according to the report. For higher education governance, the case signals that federal enforcement pressure is extending beyond individual programs to broader institutional systems—potentially affecting how universities document decisions, structure support programs, and manage compliance narratives.
