The Republican-led House Education and Workforce Committee advanced the Title IX Clarification Act of 2026, which would define “sex” as “biological” sex under Title IX. The proposal is designed to codify the U.S. Supreme Court’s recent ruling in West Virginia v. B.P.J. and Little v. Hecox, which allows athletic-team separation based on sex. Democrats on the committee opposed the bill during Tuesday’s markup, arguing it would narrow civil-rights protections for transgender students and effectively write them out of Title IX. Education policy experts also warned that federal agencies could use the Supreme Court’s framework when evaluating other LGBTQ-related issues, including pronoun usage and bathroom/locker-room access. Separately from Title IX, the committee also advanced several K-12 measures, including proposals tied to survey opt-outs for parents and federal funding to train educators and students to use artificial intelligence safely in classroom settings. Civil-rights groups and the National Education Association submitted letters urging lawmakers to oppose the Title IX bill.
