The Kansas Board of Regents unanimously approved definitions for “DEI-CRT” content to comply with a state law barring public colleges from requiring certain race-related coursework. The policy defines DEI-CRT as instruction that intentionally establishes and promotes preferential treatment based on race, color, gender, ethnicity, or national origin. The definition also carves out critical race theory as content that promotes acceptance of the view that racism is systemic in society, while explicitly excluding broader discussions of race, racism, and civil rights history from the regulated category. University of Kansas Chancellor Douglas Girod raised concerns about ambiguity in the word “promotes,” urging use of “required” instead. Implementation will require certification by the board’s chief to a state finance council by end of July, with the rule taking effect in the 2028–29 academic year. Exemptions are available for programs primarily focused on racial, ethnic, or gender studies.
