The U.S. Equal Employment Opportunity Commission agreed with the University of Pennsylvania on a joint resolution that dropped EEOC’s bid to press the university for Jewish employee information, according to a court filing. The settlement followed tensions in a case connected to antisemitic harassment allegations and EEOC subpoena demands. Under the agreement, Penn agreed to dismiss its appeal to the U.S. Court of Appeals for the Third Circuit as moot and to not seek vacatur of the district court’s opinion. The EEOC previously sought lists and de-identified data tied to religion, Jewish organizational affiliation, and participation in Jewish programming, alongside personal contact information. For higher education compliance teams, the move highlights the operational and governance stakes of employee-data requests in civil rights investigations, including consent handling, privacy protections, and how agencies structure subpoena scopes. The dispute stemmed from an EEOC charge filed in December 2023 by Andrea Lucas, now chair of the commission.
